Gandhinagar: The consumer court has ordered the insurance payment for the lung cancer treatment of a chain smoker to be paid within a month.

Madhukar Vora is a resident of Rajkot, Gujarat. He has a habit of smoking cigarettes.

He used to smoke one or two cigarettes in the beginning and eventually started smoking more than 10 cigarettes a day.

Then suddenly his condition started to suffer.. he went to the hospital and got treatment but he did not get better.. so he was admitted to a private hospital in Rajkot last February 2018… and then he was sent to Ahmedabad hospital for further treatment. It was there that he was diagnosed with lung cancer. Treatment started immediately.. Then Rs.6.53 lakh was collected as medical expenses…



Madhukar Vora had applied for the insurance company to pay the expenses… but the insurance company refused to pay the money.. and said that his claim was rejected on the grounds that he was a drug addict.. Madhukar Vora immediately took the matter to the consumer commission to resolve the issue. happened..



The insurance company then said, “During our investigation and hospital documents, it has come to light that the complainant has been smoking 15 to 20 cigarettes a day for the last 40 years. Therefore, the claim is liable to be rejected as per condition no. 4.8 of the policy. In case of alcohol or drug abuse or any such abuse or addiction.” It was contended that as per the condition of the policy, the claim could be rejected.



Subsequently, in the order issued by the consumer commission, “it is true that nicotine is mixed in cigarettes..but nicotine is not a proven drug..and it is not proved that he got cancer due to the use of cigarettes. The insurance company is failing in its service by making baseless objections..it is not proper…he was not addicted to drugs. Therefore, the insurance company has ordered to pay Rs 5,000 plus 6 per cent interest along with the sum insured within 30 days.”
